Johannesburg - A High Court ban on the words "shoot the boer" was met with mixed reaction on Friday.

While the ANC was shocked at the ruling and vowed to challenge it in the Constitutional Court, the Afrikanerbond and Freedom Front Plus welcomed it.

The SABC reported on Friday that the South Gauteng High Court had ruled that the use of the words "dubula ibhunu (shoot the boer)" was unconstitutional and unlawful.

Delmas businessman Willem Harmse had applied for an urgent interdict to prevent his colleague Mahomed Vawda from using the words on banners and singing them during a planned march against crime.

While Harmse argued that the words perpetuated hate speech and incited hatred, Vawda contended that they referred to the symbolic killing of apartheid.

The ANC, which reportedly intends appealing against the judgment, expressed astonishment at the court's failure to approach it for input on the history and purpose of the struggle song "Ayesaba Amagwala" (the cowards are scared).

The song's lyrics include the words: "aw dubul'ibhunu (shoot the Boer)'a magwala (the cowards are scared) dubula dubula (shoot shoot)".

The ANC believed that, had its input been sought, the court would have reached a different conclusion.

Unacceptable

Earlier this month, ANC secretary-general Gwede Mantashe cautioned against "systematically erasing history" and said the interpretation of the song had been "vulgarised.

"It's an old struggle song. Anybody who relegates it into hate speech today... I will regard that as a serious attempt to erase our history. If you try to erase the history through courts…that would be unfortunate to the country."

Complaints have recently been laid against ANC Youth League president Julius Malema with the Equality Court and the SA Human Rights Commission (SAHRC) over his repeated singing of the song in public.

The Freedom Front Plus viewed the ANC's contention that the words be seen in the struggle context as "totally unacceptable.

"Mr Malema was nine-years-old when (former president Nelson) Mandela was freed. He was never really part of the 'struggle'. If he sang the song today, it has to be judged in the context of 2010 and the fact that farmers are being killed weekly," the party said in a statement.

The Afrikanerbond now wants the SAHRC to decide whether the song constitutes incitement to violence and hate speech.

Its chief secretary Jan Bosman said it hoped the ruling was "a first step in forcing politicians to think about pronouncements that create the potential for conflict".

Johannesburg - Singing "shoot the boer" is now illegal, the SABC reported on Friday.

The South Gauteng High Court has ruled that use of the words is unconstitutional and unlawful, the report said.

The ruling follows an urgent interdict by Delmas businessman Willem Harmse preventing his colleague Mahomed Vawda from using banners with the words and singing the song during a march against the high rate of crime in Mpumalanga and Gauteng on April 9.

Vawda argued that the words figuratively meant "kill apartheid" and wanted them chanted at the march.

Harmse argued the words perpetuated hate speech and incited hatred.

Johannesburg - The Pan Africanist Congress Youth League's threat to kill ANC Youth League president Julius Malema and Malema's recent singing of "shoot the boer" were worrisome, the police ministry said on Friday.

Zweli Mnisi, spokesperson for Police Minister Nathi Mthethwa said: "It's worrying... it doesn't bode very well for society. It is worrying.

"In that spirit of really building a nation, it is really quite worrisome," he said after the PACYL threatened to kill Malema.

"We are saying to Malema to apologise within five days or we will injure him to death... He will either end up in a hospital or in a mortuary," PACYL president Pitso Mphasha said at a media conference held earlier on Friday.

The PACYL and the ANCYL are at loggerheads over who arranged the Sharpeville pass law uprising of 1960 - in which police shot dead 69 people.

At a commemoration on Monday, Malema said the protest had been organised by the ANC, but was then hijacked by the Pan Africanist Congress. The PAC is outraged at this suggestion.

Mphasha said the threat to Malema was a way of teaching Malema discipline the "militant way".

The ANCYL said it would respond once it had received the ultimatum directly from the PACYL, and not from a press report.

Malema has also come under fire recently for singing the phrase "shoot the boer", which has offended organisations like AfriForum, which has threatened legal action if Malema does not apologise in writing..

"It has gone a bit far," said AfriForum spokesperson Willie Spies, in response to the PACYL threat.

"It actually shows how dangerous these kinds of remarks are and how critical it is to get rid of these remarks and to get it out of our system.

Spies said that freedom of expression was important in a democracy, but could become uncontrollable if used in a divided society..."and that is what I am hearing now."

AfriForum would seek an urgent court interdict to stop Malema from singing the lyrics "shoot the boer."

Interresting when they say kill the boer it nothing but its a problem if people say lets kill Malema. Whats wrong with this picture.

Mnr. Pitso Mphasha, PAC-jeug-leier, eis ’n verskoning van Malema nadat hy vandeesweek in Mafikeng gesê het die PAC het die Sharpeville-betoging van 1960 by die ANC gekaap.

“Die uitlatings wys duidelik dat hy ’n domkop is,” het Mphasha gesê.

Die PACYL het Malema vyf dae gegee om vir sy uitlatings om verskoning te vra.

“As Malema nie verskoning vra nie, sal ons hom tot die dood beseer. Hy sal in die hospitaal of in die lykshuis beland,” het Mphasha gesê.

Mnr. Kholofelo Tshoma, PACYL-woordvoerder, het gister gesê Malema moet lig loop.

“As ons hom op straat kry, sal ons net een taal praat wat hy verstaan – en dit is nie met woorde nie,” het hy aan Sapa gesê.

Volgens die PACYL wil Malema die land se geskiedenis verdraai.

Die party het Malema vroeër die week genooi om ’n gratis geskiedenisles by te woon. Die ANC-jeugliga het geweier om bes te gee en hou vol dat die ANC eerste teen pasboeke betoog het.

Mnr. Floyd Shivambu, woordvoerder van die ANC-jeugliga, het gister die telefoon in Beeld se oor neergesit toe hy om kommentaar genader is.

"Malema’s the one who reckons that traditional songs will not have any influence out there -- but look [at] the reaction to my letter," Hofmeyr told the Mail & Guardian. He posted the letter on his website two weeks ago.

The letter is "an over-angry reaction", he says, "but it's the kind of thing that Malema should be expecting ... If you want to open this can of worms and we're going to launch insults to and fro, then it's the kind of thing that [Malema] must accept.

"If the Afrikaners must accept that they need to be shot because they are racists, I will need to remind Malema that when they wrote a book about African intellectuals, they could only find six."

He referred the Mail & Guardian to the book African Intellectuals in 19th and Early 20th Century South Africa, edited by Mcebisi Ndletyana and published in 2008.

"It’s not that you don't get intellectuals [in Africa]," Hofmeyr said, "it's that you do not get intellectuals anywhere in the world not defined against the Western background of philosophy."

He said that if anyone can point him to an African intellectual who is not influenced by Western thought, he will "happily" remove the comment from his website.

But he will not withdraw the letter, even "if it can be read in the wrong context. Isn't that what he [Malema] is asking for as well? That if you talk about raping a certain tribe in Africa, that it should be seen in context?"
